Terms of Service

By accessing or using the Digital Dineway platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including restaurant and hotel operators, their staff, and any end guests who interact with menus or ordering interfaces powered by Digital Dineway.

Digital Dineway provides a SaaS platform that enables restaurants and hotels to create and manage QR-based digital menus, receive and manage customer orders, and operate a live kitchen display system. Features vary by subscription plan.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@dineway.io if you suspect unauthorised access.

You may not share your account with others or create multiple free trial accounts. We reserve the right to terminate accounts that violate these requirements.

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Upload, transmit, or distribute harmful, fraudulent, or infringing content.
• Reverse-engineer, decompile, or attempt to derive source code from the platform.
• Use automated tools (bots, scrapers) to access or extract data without written permission.
• Interfere with or disrupt the integrity or performance of the Service or its servers.
• Circumvent any security measures or access controls.

The Digital Dineway platform, including all software, design, trademarks, and content created by us, is owned by Digital Dineway and its licensors. These Terms do not grant you any right to use our intellectual property beyond what is necessary to use the Service.

You retain ownership of all content you upload to the platform (menus, images, descriptions). By uploading content, you grant us a non-exclusive, royalty-free licence to host, display, and process it solely to provide the Service.

Access to paid features requires an active subscription. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By providing payment details, you authorise us to charge your payment method for all applicable fees.

All fees are non-refundable except as set out in our Refund Policy. We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

To the maximum extent permitted by applicable law, Digital Dineway shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including loss of revenue, data, or business opportunities.

Our total cumulative liability to you for any claims arising from these Terms or the Service shall not exceed the total fees paid by you in the three months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

You may terminate your account at any time by following the cancellation process in your account settings. We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or if we are required to do so by law.

Upon termination, your right to access the Service ceases immediately. We will handle your data in accordance with our Privacy Policy and Cancellation Policy.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

We may revise these Terms at any time. We will provide at least 14 days' notice before material changes take effect for existing subscribers. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
